End User License Agreement

1. GRANT OF LICENSE & SCOPE

Nigel Openshaw (“the Developer”) grants you a personal, non-exclusive, non-transferable, and revocable license to install and use the Software on a per-device basis.

Standard Use: This license covers one (1) installation on the applicable operating system (Windows, Android, or other supported platforms).

Non-Commercial: This license is for personal use only. Commercial exploitation, resale, or distribution is strictly prohibited without a separate Commercial Licensing Agreement.

2. MODERN RESTRICTIONS

In addition to standard prohibitions against reverse engineering and sub-licensing, you expressly agree not to:

2.1 AI Training: Use the Software, its source code, its UI, or its outputs to train, "fine-tune," or inform any Artificial Intelligence (AI), Machine Learning (ML), or Large Language Model (LLM) systems.

2.2 Automated Access: Use any "robot," "spider," or automated technology to scrape or interact with the Software in a manner that exceeds human capability.

3. INTELLECTUAL PROPERTY & OWNERSHIP

The Software is licensed, not sold. All rights, titles, and interests—including but not limited to copyrights, trade secrets, and branding—remain the exclusive property of Nigel Openshaw. This agreement does not grant you any rights to trademarks or service marks.

4. DATA INTEGRITY & PRIVACY

Consistent with our Privacy by Design philosophy, this Software operates locally.

No Data Harvesting: The Developer does not monitor your usage.

User Responsibility: You are solely responsible for the backup and security of any data you create using the Software. The Developer assumes no liability for data loss residing on your local hardware.

5. WARRANTY & STATUTORY RIGHTS (UK COMPLIANCE)

5.1 "As-Is" Provision: To the extent permitted by law, the Software is provided "As-Is" without warranty of any kind.

5.2 Statutory Rights: Nothing in this EULA affects your statutory rights under the UK Consumer Rights Act 2015 regarding digital content that is not of satisfactory quality or fit for purpose. However, the Developer does not warrant that the Software will be uninterrupted or 100% error-free.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by the laws of England and Wales, the Developer shall not be liable for any indirect, incidental, or consequential damages (including, without limitation, damages for loss of business profits, business interruption, or loss of data) arising out of the use or inability to use the Software. In no event shall the Developer's total liability exceed the amount paid by you for the Software (if any).

7. TERMINATION

This license is effective until terminated. Your rights under this EULA will terminate automatically without notice if you fail to comply with any term(s). Upon termination, you shall cease all use and destroy all copies of the Software.

8. GOVERNING LAW & JURISDICTION

This EULA is governed by and construed in accordance with the laws of England and Wales. You agree that the courts of Manchester, UK, shall have exclusive jurisdiction to settle any dispute or claim arising out of this agreement.
